Thank you SO much for this useful info Amy. My mom, sister and I will all benefit from this as we are all starting new business ventures. Should we have our trademark protected and copyrights done before showing them to different companies for licensing?

Thank you for the excellent post! Along similar lines, have you all ever written anything on Creative Commons? I'm looking for a clear and concise explanation similar to this trademark post. I am a new fan of the blog, so please excuse the question if this a repeat.

Amy, you've put our legal trademark jargon into easy to understand laypersons terms! Well done! Like your blog a lot and will definitely be on my Favourites now. Our firm does IP consultancy for the South East Asia region and here, it is also important for trademark owners to do a linguistic check on their trademarks they intend to use in Asia as the English words may have negative connotations in different languages. For eg. "Babi" is a different and fun way of spelling "Baby". However in Malaysia and Indonesia, the word "Babi" means "pig"! So a lipstick which is called "lip babi" means "pig's lips"!. For sure, the marketing of such lipsticks will be tough even more so as Muslims do not eat pork because of their religion.

Anyway, do keep on with your excellent blogging and feel free to visit our website www.kass.com.my and our Facebook page (http://www.facebook.com/home.php?#/pages/Kuala-Lumpur-Malaysia/KASS-International-Sdn-Bhd/72146675129?ref=ts) if you have any questions on linguistic checks or clearance checks in the SEA region.

I just filed a trademark for my new company, and decided to try legalzoom after hearing from a few people that they thought it was legit. So far, the experience has been really smooth! They are very attentive to the details, emailing regularly to ensure that everything was correct. It was very efficient. I just paid for the basic package but it still seemed a lot more affordable than using a lawyer, and an easy way to navigate the whole process if you don't mind spending a little more than if you did it yourself. Anyways, just thought I'd mention since sometimes it can be a bit nerve-wraking to use these online companies if you don't know anything about them. Haven't got my trademark approved yet since it apparently takes 6-12 months for that, but the filing and trademark search part went smoothly, and I felt a little more relieved that lawyers (even if they are online) were reviewing it for me.
